Pike County Court sentencing

MILFORD - Two Pike County residents will be spending some time in a state prison for DUI and related offenses

George Huber, 48, of Milford, PA, was sentenced to 8 months and 72 hours to 6 years and 6 months in a state correctional facility, fined $3,100 and had his driver’s license suspended for a length of time to be determined by PennDot for two counts of Driving Under the Influence of Alcohol or a Controlled Substance and two counts of Possession of a Controlled Substance.  The state police found Huber asleep at the wheel of his vehicle at a business parking lot entrance along SR 739 on September 13, 2016, in Blooming Grove Township.  The trooper observed empty glassine packets on Huber’s pants and vehicle seat and found Huber’s speech to be incoherent and slurred and his pupils constricted.  A Field Sobriety Test was conducted which showed impairment and a blood test confirmed the presence of Morphine, Oxycodone, Cocaine and Fentanyl in his blood.  Huber was stopped on January 7, 2017, by the state police for speeding along I-84 in Blooming Grove Township.  In speaking with Huber, the trooper observed Huber’s pupils to be constricted, and rubber bands and wax packets on the floor of his vehicle.  Huber was found in possession of Oxycodone and twenty-one packets of Heroin. A Field Sobriety Test was conducted which showed impairment and a blood test confirmed the presence of Morphine, Oxycodone and Fentanyl. 

Michael Gerard Decker, 32, of Matamoras, PA, was sentenced to 2 years and 5 days to 4 years and 6 months in a state correctional facility, fined $2,600 and had his driver’s license suspended for 12 months for 2 counts of Fleeing and Attempting to Elude Police, one count of Theft and one count of Driving Under the Influence of Alcohol or a Controlled Substance.  Decker, while a waiter at a restaurant in Westfall Township, took $200 from a patron’s purse without their permission on November 11, 2014.  Decker was stopped by the state police on August 1, 2014, for failing to stop at a stop sign along Milford Road and crossing the double yellow lines and fog lines multiple times along Silver Lake Road in Delaware Township.  Upon speaking with Decker, the trooper detected the smell of Marihuana.  A Field Sobriety Test was conducted which showed impairment and a blood test confirmed the presence of THC in Decker’s body.  Eastern Pike Regional Police attempted to stop Decker on January 11, 2016, for no inspection sticker and an unsecured license plate when he was observed traveling along Route 6 and 209 in Westfall Township.  Decker failed to stop and entered I-84 at a high rate of speed.  On October 2, 2016, while driving on a suspended license, Decker eluded police through the streets of the Borough of Matamoras and was eventually located hiding in a tree house in Westfall Township.

Other criminal sentences issued by Pike County Court of Common Pleas Judge Gregory Chelak:

Michael Edmund Smith, 44, Lake Ariel, PA, was sentenced to 30 days to 90 days in the Pike County Jail, fined $500 and had his driver’s license suspended for a length of time to be determined by PennDot for Operating a Vehicle Without Interlock Ignition.  The state police stopped Smith on November 16, 2016, while traveling along I-84 in Palmyra Township for an expired registration.  In reviewing Smith’s license, the trooper became aware that Smith had an ignition interlock restriction, however the vehicle Smith was driving had no ignition interlock.

Monica Marie Garcia, 28, of Bushkill, PA, was sentenced to 7 months to 14 months in the Pike County Jail and fined $800 for the crimes of Recklessly Endangering Another Person and Criminal Mischief.  During a verbal dispute on August 3, 2016, Garcia fired a gun in the vicinity of a man leaving leaving his residence in Lehman Township.  One of the rounds struck a neighboring sliding glass door causing in excess of $500 in damages.

Shawnia L. Faherty, 45, Fall River, MA, was sentenced to a $300 fine for Possession of Drug Paraphernalia.  A DCNR Ranger was checking on an unpermitted campsite along Five Mile Meadow Road in Blooming Grove Township on July 29, 2016. Faherty was found in possession of a Marihuana baggie, blunt and pipe.

Joseph Edward Oliva, 27, of Shohola, PA, was sentenced to a $300 fine for Criminal Mischief.  Oliva sliced tires of a vehicle with a value in excess of $500 that was parked at a residence in Matamoras Borough on January 12, 2016.

Ricky Jeanmarie, 26, Brooklyn, NY, was sentenced to 18 months of probation and fined $300 for Access Device Fraud.  Jeanmarie conspired with another individual to use counterfeit credit cards to purchase merchandise and gift cards in an amount in excess of $4,000 from a retail business in Westfall Township on June 5, 2016 and June 7, 2016.
