Wayne County Court sentences

HONESDALE - The following cases were addressed by President Judge Janine Edwards and Senior Judge Raymond Hamill:

Celio Villalba-Diazgranados, 45 of Honesdale, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 9 months nor more than 23 months for one count of Aggravated Assault –Deadly Weapon (F2).  He was also ordered to pay costs of prosecution, continue mental health treatment and comply with any recommendation for treatment, complete anger management program provided by parole officer and no contact with victim. Submit to drawing of a DNA sample and pay $250 for cost. The incident occurred on October 22, 2018 in Wayne County.

Collan Parry, 20 of Moscow, PA, was sentenced to the Wayne County Correctional Facility for a period of not less than 90 days nor more than 23 ½ months for one count of Fleeing or Attempting to Elude a Police Officer (M2) and one count of Driving While Operating Privilege Suspended/Revoked-DUI related (S) He was also ordered to pay the costs of prosecution and pay a fine in the amount of $710 for one count of Overtaking Vehicle on the Right Side (S) and Exceed Maximum Speed Limit Established by 80 mph (S). Continue drug and alcohol treatment and comply with any recommendation for treatment and continue mental health treatment and comply with any recommendation for treatment.  Obtain employment within 30 days of parole and maintain employment while on a parole. The incident occurred on October 31, 2018, in Salem Township, Wayne County.

Christopher Brownell, 29 of Moscow, PA, was sentenced to the Wayne County Correctional Facility for a period of not less than 7 months nor more than 42 months for one count of Possession of Controlled Substances - Heroin (M) and one count of Possession of Drug Paraphernalia (M). He was also ordered to pay the costs of prosecution and be placed on GPS Electronic Monitoring for a period of 3 months. Resolve all outstanding warrants within 60 days. Undergo drug and alcohol evaluation and comply with any recommendation for treatment and undergo mental health evaluation and comply with any recommendation for treatment. The incident occurred on December 28, 2018 in Dreher Township, Wayne County.

Jerimiah Johnson, 23 of Honesdale, PA, was sentenced to the Wayne County Correctional Facility for a period of not less than 4 months nor more than 23 ½ months for one count of Simple Assault (M2).  He was also ordered to pay the costs of prosecution, undergo drug and alcohol evaluation and comply with any recommendation for treatment, undergo mental health evaluation and comply with any recommendation for treatment and completed an anger management course provided by parole officer. Obtain employment within 30 days of parole. The incident occurred on April 9, 2019 in Honesdale Borough, Wayne County.

Tyler Lazaro, 19 of Honesdale, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 10 days nor more than 12 months for one count of possession of Drug Paraphernalia (M).  He was also ordered to pay the costs of prosecution, undergo drug and alcohol evaluation and comply with any recommendation for treatment, and undergo mental health evaluation and comply with any recommendation for treatment.  Obtain employment within 30 days of parole. The incident occurred on March 3, 2018, in Honesdale Borough, Wayne County.

Susan Fairbanks, 21 of Equinunk, PA was placed on probation for 6 months for one count of Disorderly Conduct – Engage in Fighting (M3). She was also ordered to pay the costs of prosecution, and continue mental health treatment and comply with any recommendation for

Devon Muro 18 of Kingston, PA, was placed on probation for a period of 12 months for one count of Possession of a Controlled Substance- Heroin (M). He was also ordered to pay the costs of prosecution and undergo drug and alcohol evaluation and comply with any recommendation for treatment.  The incident occurred on March 22, 2018 in Honesdale Borough, Wayne County.

Sandra Swendsen, 25, of Lakewood, was placed on probation for a period of 12 months for one count of Obstructing Administration of Law or Other Governmental Function (M2) and one count of Simple Assault (M1).  She was also ordered to pay costs of prosecution. The incident occurred on March 19, 2019 in Preston, Township .

Christian Terell, 38, of Waymart, was sentenced to the Wayne County Correctional Facility for a period of not less than 15 days nor more than 12 months for one count of Criminal Mischief (M3). He was also ordered to pay costs of prosecution, pay restitution in the amount of $600, undergo drug and alcohol evaluation and comply with any recommendation for treatment, and undergo mental health evaluation and comply with all recommendation for treatment.  Refrain from contact with victim. The incident occurred on March 13, 2019 in Waymart Borough, Wayne County.

Babara Tyson, 51, of Hawley was placed on probation for a period of 6 months for one count of Theft by Unlawful Taking of Disposition (M3). She was also ordered to pay the costs of prosecution, pay a fine in the amount of $300 and pay restitution in the amount of $4,000.  The incident occurred on November 17, 2010 through June 22, 2017 in Palmyra Township, Wayne County.  

Robert Stevenson, 59, of Greeley was placed on probation for a period of 6 months for one count of Driving Under Influence (M). He was also ordered to pay costs of prosecution, pay a fine in the amount of $300, and attend and complete the Alcohol Highway Safety Program. 

Tyson Blount, 34, of Roslyn, PA, was sentenced to a State Correctional Institution for a period of not less than 45 months nor more than 90 months concurrent to any sentence currently being served for one count of Robbery (F2). He was also ordered to pay the costs of prosecution, pay restitution in the amount $19,403.50. Pay $250 to the DNA Detection Fund. The incident occurred on October 19, 2018 in Texas Township.

Emily McNichols, 20, of Honesdale was sentenced to Wayne County Correctional Facility for a period of not less than 30 days nor more than 12 months for one count Possession of Drug Paraphernalia (M).  She was also orderd to pay the costs of prosecution, participate in and cooperate with drug and alcohol addiction treatment and undergo a mental health evaluation and comply with all recommendation for treatment. Obtain employment or enroll in college course within 30 days of sentencing and show documents of doing so. The incident occurred on July 6, 2017, in Honesdale Borough.

Brian Crocker, 61, of Lake Ariel was sentenced to the Wayne County Correctional Facility for a period of 10 days and followed by the Intermediate Punishment Program as a level 3 offender for a period of 60 months less 10 days for one count of DUI (M1). He was also ordered to pay the costs of prosecution, pay a fine in the amount of $1,500, be placed on House Arrest with Electronic and Alcohol Monitoring through the SCRAM Program for a period of 6 months, participate in and cooperate with the drug and alcohol addiction treatment, and complete the Alcohol Highway Safety Program. The incident occurred on December 3, 2018 in Lake Township. His blood test revealed a BAC of .183%.

Jose Clark 30 of Simpson, PA was sentenced to the Wayne County Correctional Facility for a period of not less than 5 days nor more than 12 months for one count of Fleeing or Attempting to Elude A Police Officer  (F3). He must also perform 25 hours of community service within 6 months for one count Reckless Endangering Another Person (M2).  He was also ordered to pay the costs of prosecution, pay a fine in the amount of $1,300, submit to the drawing of a DNA sample and pay $250 for the cost. The incident occurred on July 21, 2018 in Clinton Township.

Donato D’andrea, 29, of Lake Ariel was placed on probation for a period of 24 months for one count of Receiving Stolen Property (M1). He was ordered to pay the costs of prosecution, pay restitution in the amount of $1,880. Undergo a drug and alcohol evaluation and comply with any recommendation for treatment and maintain employment while on supervision. The incident occurred on January 8, 2019, in Sterling Township.

John Metzger, 46, of Gouldsboro was placed in the Intermediate Punishment Program for a period of 6 months as a level 3 offender for one count of DUI (M).  He was also ordered to pay the costs of prosecution and a fine of 1,500, be placed on House Arrest with Electronic and Alcohol Monitoring through the SCRAM Program for 90 days, and participate in and cooperate with the drug and alcohol addiction treatment for one count Driving While Operating Privilege Suspended/Revoked (S). He must also complete the Alcohol Highway Safety Program and perform complete 25 hours of community service within 6 months.  Continue mental health treatment and comply with all recommendation for treatment. The incident occurred on December 25, 2018 in Lehigh Township.

Raymond Swick, 47 of Damascus was placed on probation for a period of 12 months related to two counts of Unsworn Falsification to Authorities (M2).  He was also ordered to pay the costs of prosecution and continue mental health treatment and comply with all recommendation for treatment. The incident occurred on May 29, 2018 in Honesdale Borough.

Tyler Canfield, 22 of Honesdale, was placed on the Accelerated Rehabilitative Disposition Program for a period of 6 months related to DUI. He was also ordered to pay all Court costs, perform 25 hours of community service and have his operator’s privileges suspended for 60 days and complete the Alcohol Highway Safety Program. The incident occurred on November 25, 2018 in Berlin Township. His blood test revealed a BAC of .211%.

Anthony Nazzaro, 19, of Callicoon NY, was placed on the Accelerated Rehabilitative Disposition Program for a period of 6 months related to Retail Theft. He was also ordered to pay all Court costs and perform 25 hours of community service. The incident occurred on October 24, 2018 in Texas Township.
